The “Real Estate Network” includes various Web pages operated by “Real Estate Network”.
The services of “Real Estate Network” are offered to you in accordance with your acceptance of the terms, conditions, and notices contained herein.
Your use of the “Real Estate Network” constitutes your agreement to all such terms, conditions, and notices.
Purpose and Use of “Real Estate Network” as Marketplace: “Real Estate Network” provides the Marketplace solely as a location for buyers to locate and purchase new and used products and services from sellers like you that are independent of “Real Estate Network”. When buyers make a purchase from you, they are purchasing the product from you and not from “Real Estate Network”. You agree that “Real Estate Network” is not an agent for you or for the buyer and has no authority to act on your or on a buyer's behalf. Because “Real Estate Network” is not involved in the transaction between you and buyers, “Real Estate Network” has no control over the buyers who make purchases or the ability of buyers to pay for items they may purchase from you. “Real Estate Network” has no responsibility to ensure that a buyer completes a transaction with you or makes final payment to you. You agree and represent and warrant that your use of the “Real Estate Network” will comply with applicable laws, ordinances and regulations. At any time, “Real Estate Network” may terminate this Agreement and may halt any pending listings or sales at any time without notice to you.
Modification of These Terms of Use
“Real Estate Network” reserves the right to change the terms, conditions, and notices under which the services of “Real Estate Network” is offered, including but not limited to the changes associated with the use of the “Real Estate Network” .
We urge that you read “Real Estate Network”'s Privacy Policy which governs the protection and use of each User's information in “Real Estate Network”'s possession. Each User hereby accepts the Privacy Policy and any updates and amendments thereto. Each User acknowledges that “Real Estate Network” may change the Privacy Policy from time to time provided that “Real Estate Network” shall make available the updated version of the Privacy Policy on the Site at all times. Your continuation of use of the Site shall be deemed to be your acceptance of the Privacy Policy which is then displayed on the Site at the time of such use.
“Real Estate Network” Inbox
“Real Estate Network” may assign a web-based email account with limited storage space for the User to send or receive email (the "Email Account"). The User shall be responsible for all users and the content of all the messages communicated through the Email Account, as well as the consequences of any such message.
The Registered User shall not use the Email Account for junk mail, chain letters or spamming or the transmission of any unlawful, harassing, libelous, abusive, threatening, harmful, vulgar, obscene or otherwise objectionable material of any kind or nature. Further, the Registered User shall not use the Email Account to publish, distribute, transmit or circulate any unsolicited advertising or promotional information or any content that is obscene, indecent, seditious, offensive, defamatory, threatening, or which incites or results in causing racial hatred, discrimination, menace or breach of confidence.
License and Site Access
“Real Estate Network” grants you a limited license to access and make personal use of this site and not to download (other than page caching) or modify it, or any portion of it, except with express written consent of “Real Estate Network”. This license does not include any resale or commercial use of this site or its contents; any collection and use of any product listings, descriptions, or prices; any derivative use of this site or its contents; any downloading or copying of account information for the benefit of another merchant; or any use of data mining, robots, or similar data gathering and extraction tools. This site or any portion of this site may not be reproduced, duplicated, copied, sold, resold, visited, or otherwise exploited for any commercial purpose without express written consent of “Real Estate Network”. You may not frame or utilize framing techniques to enclose any trademark, logo, or other proprietary information (including images, text, page layout, or form) of “Real Estate Network” without express written consent. You may not use any meta tags or any other "hidden text" utilizing “Real Estate Network”'s name or trademarks without the express written consent of “Real Estate Network”. Any unauthorized use terminates the permission or license granted by “Real Estate Network”. You are granted a limited, revocable, and nonexclusive right to create a hyperlink to the home page of “Real Estate Network” so long as the link does not portray “Real Estate Network”, or its products or services in a false, misleading, derogatory, or otherwise offensive matter. You may not use any “Real Estate Network” logo or other proprietary graphic or trademark as part of the link without express written permission.
Your Account
If you use this site, you are responsible for maintaining the confidentiality of your account and password and for restricting access to your computer, and you agree to accept responsibility for all activities that occur under your account or password. If you are under 18, you may use “Real Estate Network” only with involvement of a parent or guardian. “Real Estate Network” reserves the right to refuse service, terminate accounts, remove or edit content, or cancel orders in their sole discretion.
Reviews, Comments, Communications, and other content
Visitors may post reviews, comments, photos, and other content; send e-cards and other communications; and submit suggestions, ideas, comments, questions, or other information, so long as the content is not illegal, obscene, threatening, defamatory, invasive of privacy, infringing of intellectual property rights, or otherwise injurious to third parties or objectionable and does not consist of or contain software viruses, political campaigning, commercial solicitation, chain letters, mass mailings, or any form of "spam." You may not use a false e-mail address, impersonate any person or entity, or otherwise mislead as to the origin of a card or other content. “Real Estate Network” reserves the right (but not the obligation) to remove or edit such content, but does not regularly review posted content.
If you do post content or submit material, and unless we indicate otherwise, you grant “Real Estate Network” a nonexclusive, royalty-free, perpetual, irrevocable, and fully sub licensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media. You grant “Real Estate Network” and sub licensees the right to use the name that you submit in connection with such content, if they choose. You represent and warrant that you own or otherwise control all of the rights to the content that you post; that the content is accurate; that use of the content you supply does not violate this policy and will not cause injury to any person or entity; and that you will indemnify “Real Estate Network” for all claims resulting from content you supply. “Real Estate Network” has the right but not the obligation to monitor and edit or remove any activity or content. “Real Estate Network” takes no responsibility and assumes no liability for any content posted by you or any third party.
Electronic Communication
When you visit “Real Estate Network” or send e-mails to us, you are communicating with us electronically. You consent to receive communications from us electronically. We will communicate with you by e-mail or by posting notices on this site. You agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
Consent To Our Communication With You By E-Mail. By establishing a My Account with us, and each time you make a listing or changes through our Site, you grant permission for “Real Estate Network” to contact you at your e-mail address. To stop receiving our marketing emails, click on Notification setting in your account and set whatever you want to receive or not.
Transactions between Buyers and Suppliers
1. Users are hereby made aware that there may be risks of dealing with people acting under false pretences. “Real Estate Network” uses several techniques to verify the accuracy of the information our users provide us when they register on the Site. However, because user verification on the Internet is difficult, “Real Estate Network” cannot and does not confirm each User's purported identity (including, without limitation, Verified Label Holder Members). We encourage you to use the various tools available on the Site, as well as common sense, to evaluate with whom you are dealing.
2. Each User acknowledges that it is fully assuming the risks of purchase and sale transactions when using the Site to conduct transactions, and that it is fully assuming the risks of liability or harm of any kind in connection with subsequent activity of any kind relating to products or services that are the subject of transactions using the Site. Such risks shall include, but are not limited to, mis-representation of products and services, fraudulent schemes, unsatisfactory quality, failure to meet specifications, defective or dangerous products, unlawful products, delay or default in delivery or payment, cost mis-calculations, breach of warranty, breach of contract and transportation accidents. Such risks also include the risks that the manufacture, importation, export, distribution, offer, display, purchase, sale and/or use of products or services offered or displayed on the Site may violate or may be asserted to violate Third Party Rights, and the risk that User may incur costs of defense or other costs in connection with third parties' assertion of Third Party Rights, or in connection with any claims by any party that they are entitled to defense or indemnification in relation to assertions of rights, demands or claims by Third Party Rights claimants. Such risks also include the risks that consumers, other purchasers, end-users of products or others claiming to have suffered injuries or harms relating to product originally obtained by Users of the Site as a result of purchase and sale transactions in connection with using the Site may suffer harms and/or assert claims arising from their use of such products. Each User agrees that “Real Estate Network” shall not be liable or responsible for any damages, liabilities, costs, harms, inconveniences, business disruptions or expenditures of any kind that may arise a result of or in connection with any Transaction Risks.
3. Users are solely responsible for all of the terms and conditions of the transactions conducted on, through or as a result of use of the Site, including, without limitation, terms regarding payment, returns, warranties, shipping, insurance, fees, taxes, title, licenses, fines, permits, handling, transportation and storage.
4. In the event that any User has a dispute with any party to a transaction, such User agrees to release and indemnify “Real Estate Network” (and our agents, affiliates, directors, officers and employees) from all claims, demands, actions, proceedings, costs, expenses and damages (including without limitation any actual, special, incidental or consequential damages) arising out of or in connection with such transaction.
Purchase Products/Services
Conditions of Sale and Payment Terms: To use services on our Site, you must be at least eighteen (18) years of age or the applicable state/country age of majority. Prior to the purchase of any services on our Site, you must provide us with a valid credit card number and associated payment information including all of the following: (i) your name as it appears on the card, (ii) your credit card number, (iii) the credit card type, (iv) the date of expiration and (v) any activation numbers or codes needed to charge your card. By submitting that information to us, you hereby agree that you authorize us to charge your card at our convenience but within thirty (30) days of credit card authorization. All sales of products and services are final. All charges from those sales are nonrefundable.
Purchase Acceptance Policy (Membership, Order Advertising services)
Your receipt of an electronic or other form of purchase confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. “Real Estate Network” reserves the right at any time after receipt of your order to accept or decline your order for any reason. Your order will be deemed accepted by “Real Estate Network” upon performance of services that you have ordered, or upon the completion of the license and delivery of a Digital Download, as indicated by our servers. Title to goods and all risk of loss passes to you upon delivery to the common carrier. All orders placed over $1000.00 (U.S.) must obtain pre-approval with an acceptable method of payment, as established by our credit and fraud avoidance department. We may require additional verifications or information before accepting any order.
No Responsibility To Sell Mis-priced Products Or Services: “Real Estate Network” shall have the right to refuse or cancel any orders placed for products and/or services listed at an incorrect price, rebate or refund, or containing any other incorrect information or typographical errors. “Real Estate Network” shall have the right to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, “Real Estate Network” shall immediately issue a credit to your credit card account in the amount of the charge.
Modifications to Prices or Billing Terms: “Real Estate Network” RESERVES THE RIGHT, AT ANY TIME, TO CHANGE ITS PRICES AND BILLING METHODS FOR PRODUCTS OR SERVICES SOLD, EFFECTIVE IMMEDIATELY UPON POSTING ON THE SITE OR BY E-MAIL DELIVERY TO YOU.
Taxes: You agree that you and seller are responsible for determining the amount of sales, use or other taxes that you may owe as a result of your Marketplace purchase. You are responsible to collect, report and remit any sales, use or other taxes required under applicable law. You agree (a) that “Real Estate Network” has no responsibility to collect, report or remit sales, use or any other applicable taxes in connection with your purchase, and (b) to fully indemnify, defend and hold “Real Estate Network” and each seller harmless from any and all claims, demands, damages, awards, fines, costs, expenses and liability in any way associated with foregoing. Without limiting the generality of the foregoing.
Links to Third Party Sites
The “Real Estate Network” may contain links to others ("Linked Sites").
Though all care would be taken to check the content of the site to be appropriate in all respects for general public, however:
The Linked Sites are not under the control of “Real Estate Network” and “Real Estate Network” is not responsible for the content of any such Linked Site, including, without limitation, any link contained in a Linked Site, or any changes or updates to a Linked Site.
“Real Estate Network” is not responsible for web casting or any other form of transmission received from any Linked Site.
“Real Estate Network” provides these links to you only as a convenience, and the inclusion of any such link does not imply any kind of support by “Real Estate Network” of the site or any association with its operation.
No Unlawful or Prohibited Use
As a condition of your use of the “Real Estate Network”, you warrant to “Real Estate Network” that you will not use the “Real Estate Network” for any purpose that is unlawful or forbidden by these terms, conditions, and notices.
You may not use the “Real Estate Network” in any manner which could harm, hinder, burden, or impair the “Real Estate Network” or interfere with any other party's use of the “Real Estate Network”.
You may not obtain or try to obtain any materials or information through any means not intentionally made available or provided for through the “Real Estate Network”.
Each User hereby represents, warrants and agrees that information submitted to “Real Estate Network” for display on the Site and messages or information sent by a User through communication systems provided by the Site, or through emails, fax or letters to addressees obtained from the Site, shall not contain any of the materials described shall not:
1. contain fraudulent information or make fraudulent offers of items or involve the sale or attempted sale of counterfeit or stolen items or items whose sales and/or marketing is prohibited by applicable law, or otherwise promote other illegal activities;
2. be part of a scheme to defraud other Users of the Site or for any other unlawful purpose;
3. relate to sale of products or services that infringe or otherwise abet or encourage the infringement or violation of any third party's copyright, patent, trademarks, trade secret or other proprietary right or rights of publicity or privacy, or any other Third Party Rights;
4. impersonate any person or entity, misrepresent your or your affiliation with any person or entity;
5. violate any applicable law, statute, ordinance or regulation (including without limitation those governing export control, consumer protection, unfair competition, anti-discrimination or false advertising);
6. be defamatory, libelous, unlawfully threatening or unlawfully harassing;
7. be obscene or contain or infer any pornography or sex-related merchandising or any other content or otherwise promotes sexually explicit materials or is otherwise harmful to minors;
8. promote discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
9. contain any material that constitutes unauthorized advertising or harassment (including but not limited to spamming), invades anyone's privacy or encourages conduct that would constitute a criminal offence, give rise to civil liability, or otherwise violate any law or regulation;
10. solicit business from any Users in connection with a commercial activity that competes with “Real Estate Network”;
11. contain any computer viruses or other destructive devices and codes that have the effect of damaging, interfering with, intercepting or expropriating any software or hardware system, data or personal information;
12. link directly or indirectly to or include descriptions of goods or services that are prohibited under this Agreement;
13. violate any provision in the Product Listing Policy;
14. otherwise create any liability for “Real Estate Network” or its affiliates.
Networking
Your interactions with other Members in connection with the Services or with advertisers, including, without limitation, payment and delivery of goods or services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and the other Members or the advertiser. You agree that “Real Estate Network” will not be responsible for any loss or damage incurred as the result of any such dealings or with respect to any other Member's use or disclosure of your personally identifiable information. If there is a dispute between you and any third party (including, without limitation, any Member), “Real Estate Network” is under no obligation to become involved; however, we reserve the right, but have no obligation, to monitor disputes between you and other Members.
You agree not to reproduce, retransmit, disseminate, sell, distribute, perform, display, publish, broadcast, circulate, create new works from, or commercially exploit the Services (including the content and information made available through the Services), in whole or in part, in any manner, without the express written consent of “Real Estate Network” , nor to use the content or information made available through the Services for any unlawful purpose. You agree to access the Services manually by request and not programmatically by macro or other automated means.
Blog
All comments, feedback, suggestions and ideas disclosed, submitted or offered to “Real Estate Network” in any way or in connection with your use of this Site (collectively, "Comments"), shall be and remain the exclusive property of “Real Estate Network” and may be used in any medium and for any purpose worldwide without obtaining your specific consent. Your name may be used with any Comments you submit; although this is rare and consent is usually asked for and obtained. The “Real Estate Network” is not under any obligation to maintain your Comments (and the use of your name with any comments) in confidence, to pay to you any compensation for any Comments submitted or to respond to any of your Comments. You agree that you will be solely responsible for the content of any Comments you make. In our sole discretion, any Comments we consider offensive, improper or inappropriate, may be modified or deleted, and can, at our discretion, result in immediate termination of your membership without refund.
Copyrighting your Submissions (Including Video)
All persons and companies submitting music, writing, film, video or any other kind of copyrightable materials are urged to copyright the material prior to submission. “Real Estate Network” is not responsible for any copyright damages; abuse or copying of submitted materials, or any other losses or damages resulting from submission of materials to our reviewers or staff.
In certain circumstances you may choose to submit film, video, music or other creative material (collectively, "Materials") to “Real Estate Network” for the purposes of “Real Estate Network” providing to you, at your request, exposure to parties seeking to hire, license or procure film, television, video game and other film related projects, or other services.
With regards to all video and any other creative Material you submit to “Real Estate Network” through any of our websites or otherwise, you expressly authorize “Real Estate Network” to transmit, stream, download, transfer, broadcast, publicly display and publicly perform in any manner, form or media whether now known or hereafter devised, any of the Materials you submit to “Real Estate Network” for demonstration purposes only, SOLELY IN CONNECTION WITH THE SITE(S) YOU SUBMIT THE MATERIALS TO. Without limitation to other licenses you may be inferred to have granted in order to accomplish the foregoing, you expressly grant to “Real Estate Network” the following licenses with respect to any and all Materials you submit.
Public performance license for video
Whether or not you are a member of a performing rights society, you hereby grant “Real Estate Network” a nonexclusive, direct license to publicly perform all video included in your Materials, worldwide, for demonstration purposes. If you belong to a performing rights society you understand that it is your sole responsibility to notify your performing rights society of the direct license you have granted herein.
Public performance license for sound recordings
You hereby grant “Real Estate Network” a nonexclusive license to publicly perform by means of digital audio transmission all sound recordings included in your Materials, worldwide, for demonstration purposes.
Reproduction licenses for compositions and sound recordings
You hereby grant “Real Estate Network” nonexclusive reproduction licenses for all compositions and sound recordings included in your Materials limited to reproducing by download the Materials for demonstration purposes.
User Forum
The Site may include bulletin boards, Messenger or other user forums ("Forums").
Such Forums are provided to give users an interesting and stimulating platform to express their opinions and share their ideas and information with similar minded users.
You are cautioned that certain message boards and similar user forums may disclose a user’s IP address along with the user’s name and message.
To protect your safety, you are supposed to use your best judgment when using these forums, and consider carefully whether you want to disclose any information that can be used to identify or locate you.
“Real Estate Network” is not responsible for any material posted on the Forums, and it is a condition of your use of the Forums and the Site that you shall not upload, transmit, distribute, post or otherwise publish through such Forums and/or any portion of the Site any content that:

8. Advocates illegal activity, violates any local, state, national or international law, rule, guideline or regulations, or otherwise creates liability;
9. Unfairly interferes with any third party’s uninterrupted use and enjoyment of the Site and/or violates any right of “Real Estate Network” ;
10. Advertises or otherwise solicits funds or is a solicitation of funds for goods or services or solicits any illegal act.
While “Real Estate Network” does not and cannot review every message posted by users in the Forums, and is not responsible for the content of these messages,
“Real Estate Network” reserves the right to delete, move, or edit messages that it, in its sole discretion, deems to be in violation of the above listed guidelines or that it otherwise deems to be abusive, harmful or unacceptable.
You acknowledge that “Real Estate Network” reserves the right to, and may from time to time, monitor any and all information transmitted or received, for operational and other purposes. Use of the Site constitutes consent to such monitoring.

“Real Estate Network” AND/OR ITS SUPPLIERS HEREBY DISCLAIM ALL WARRANTIES AND CONDITIONS WITH REGARD TO THIS INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS, INCLUDING ALL IMPLIED WARRANTIES OR CONDITIONS OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL “Real Estate Network” AND/OR ITS SUPPLIERS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF USE, DATA OR PROFITS, ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE USE OR PERFORMANCE OF THE “Real Estate Network” , WITH THE DELAY OR INABILITY TO USE THE “Real Estate Network” OR RELATED SERVICES, THE PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR FOR ANY INFORMATION, SOFTWARE, PRODUCTS, SERVICES AND RELATED GRAPHICS OBTAINED THROUGH THE “Real Estate Network” , OR OTHERWISE ARISING OUT OF THE USE OF THE “Real Estate Network” , WHETHER BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY OR OTHERWISE, EVEN IF “Real Estate Network” OR ANY OF ITS SUPPLIERS HAS BEEN ADVISED OF THE POSSIBILITY OF DAMAGES. BECAUSE SOME STATES/JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.
IF YOU ARE DISSATISFIED WITH ANY PORTION OF THE “Real Estate Network” , OR WITH ANY OF THESE TERMS OF USE, YOUR SOLE AND EXCLUSIVE REMEDY IS TO DISCONTINUE USING THE “Real Estate Network” .
Termination/Access Restriction
“Real Estate Network” reserves the right, in its sole discretion, to terminate your access to the “Real Estate Network” and the related services or any portion thereof at any time, without notice. GENERAL To the maximum extent permitted by law, this agreement is governed by the laws of the State of California, USA. And you hereby consent to the exclusive jurisdiction and venue of courts in Los Angeles, California, . In all disputes arising out of or relating to the use of the “Real Estate Network” . Use of the “Real Estate Network” is unauthorized in any jurisdiction that does not give effect to all provisions of these terms and conditions, including without limitation this paragraph. You agree that no joint venture, partnership, employment, or agency relationship exists between you and “Real Estate Network” as a result of this agreement or use of the “Real Estate Network”.
“Real Estate Network”’s performance of this agreement is subject to existing laws and legal process, and nothing contained in this agreement is in derogation of “Real Estate Network”’s right to comply with governmental, court and law enforcement requests or requirements relating to your use of the “Real Estate Network” or information provided to or gathered by “Real Estate Network” with respect to such use. If any part of this agreement is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and the remainder of the agreement shall continue in effect.
Unless otherwise specified herein, this agreement constitutes the entire agreement between the user and “Real Estate Network” with respect to the “Real Estate Network” and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral or written, between the user and “Real Estate Network” with respect to the “Real Estate Network”.
A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to this agreement to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
It is the express wish to the parties that this agreement and all related documents be drawn up in English.
Refund Policy
There are no refunds for any order or services submitted for “Real Estate Network” services and products.
To know why and get more details read all terms and conditions of this Refund Policy and if you have any concerns or do not accept the terms, do not register or use “Real Estate Network” services.
1. To use “Real Estate Network” services, you will have the opportunity to use and/or view different sections and services free of charge. Before placing any order for membership or advertising with us or any other paid services, such as featured listing, you will receive a full description of the process to understand what will happen and will also need to complete several steps to complete payment.
After order submission there is no chance to cancel and no refund available.
2. After order for any services your services will begin immediately with no chance to cancel.
3. If you have any doubt about your order process, you have the option to use FAQ and/or online support to get your answers and before submitting your order. You can ask any questions prior to submitting your order.
4. If you encounter any technical difficulty with your order such as, membership, verification label, advertisements and order as featured ... open a ticket from the Help section and/or talk with one of our live support technicians, to resolve your problem as soon as possible.
5. If you order a featured listing and your offer date has expired, and you do not want to display more, you can use a credit balance for your next order or transfer the credit balance to another “Real Estate Network” member.
6. If you order by mistake or miss typing, and etc, talk to “Real Estate Network” support and they will modify your order. If there is any remaining balance, you can use it as credit in your next order or transfer to other “Real Estate Network” members.
7. If you use promotion code as payment for your order of services, you can not transfer the balance to other “Real Estate Network” members.
8. If you use promotion code as payment for your order, and the promotion code is not equal to the order and you may use your credit card or other payment method to pay the balance; If your listing has expired and you would like to use your credit balance to transfer to other “Real Estate Network” members, only can transfer your payment amount only without transferring your promotion code.
Referrals and Commissions
Users can refer other people to “Real Estate Network” and get commission on their spending money with “Real Estate Network”.
1. Users can refer people by sending invitation or by sending specific link in different web pages.
2. Invitation can be from referral section and invite friend in network section.
3. “Real Estate Network” agrees to pay Partner the commission specified in the referral section; if “Real Estate Network” sells to a visitor a product or service that is the subject of the referral linked and if that visitor has accessed “Real Estate Network” and purchased the product or service via a Qualifying Link; Commissions shall be paid according to this agreement.
4. A "Qualifying Link" is a link from a referral to “Real Estate Network”. If it is the last link on “Real Estate Network” the Customer used during a Session where a sale of a product or a service to Customer occurs.
A "Session" is the period of time beginning from a Customer's initial contact with “Real Estate Network” via a referred link and terminating when the Customer either returns to the “Real Estate Network” via a link from the site or link other than that referred link or the membership of “Referring User” expires or is terminated.
5. “Real Estate Network” shall have the sole right and responsibility for processing all orders made by Customers. “Referring User” acknowledges that all agreements relating to sales to Customers shall be between “Real Estate Network” and the Customer.
6. Commission may be earned only on credit card transactions. Purchases paid by gift certificate, check, or methods other than credit card are not eligible for commissions.
7. All determinations of Qualifying Links and whether a commission is payable will be made by Real Estate Network Inc. and will be final and binding on both “Real Estate Network” and “Referring User”. Prices for the products/services will be set solely by “Real Estate Network” in its discretion.
8. In the event “Real Estate Network”, in its sole discretion, suspects fraud or other unlawful conduct by “Referring User” or by any third party accessing “Real Estate Network” through referred link, “Real Estate Network” shall confer with “Real Estate Network” Affiliate Network to suspend or deny payments in whole or in part to “Referring User”.
9. You may not use any Qualifying Links (or any equivalent link or mechanism that, upon being activated, causes the same result as clicking on a Qualifying Link) in any electronic message unless:
* you have received the express authorization of “Real Estate Network” to use email or other electronic messages, as applicable, to promote its Qualifying Link; and
* any and all such electronic messages complies in all respects with this agreement, “Real Estate Network”'s Master Agreement and any and all applicable laws.
* Further, except as expressly authorized by “Real Estate Network”, any and all electronic messages initiated or sent by you or on your behalf may not:
* Identify any other person or entity, including “Real Estate Network”, as a sender or sponsor of any electronic message sent by you or on your behalf; nor
* Contain content which has as its primary purpose the promotion of “Real Estate Network”, a Network Affiliate (other than you), whether or not any Qualifying Link is used. All electronic messages sent by you or on your behalf must feature the service or product offering you are providing as its primary purpose; nor
* Contain sexually-oriented material without placing warning labels and otherwise complying with applicable laws including the Can Spam Act of 2003 in all respects; nor
* Be sent by or through any computer without authorization, including by relay or retransmission, or contain false header information regarding the transmitting computers and transmission path including the originating electronic mail address, domain name or Internet Protocol address.
* Should you be expressly authorized to promote “Real Estate Network” or Qualifying Link using an electronic message, in addition to any other applicable terms of the relevant Engagement, you agree to comply with the Can Spam Act of 2003 and any rules and regulations that are promulgated by any governmental authority in respect thereof and any and all orders, judgments and decrees of any court, agency or other authority relating thereto and any other applicable foreign, federal, provincial, state, or local law applicable to the use or transmission of electronic message. While some of the requirements of the Can Spam Act of 2003 are set forth as contractual obligations hereunder, compliance with the above provisions shall not be construed as or deemed to be sufficient to comply with any such or other applicable law.
10. Not an email or other service provider.
“Real Estate Network”'s referral program is as an affiliate partner and an Online Affiliate. Your participation is purely voluntarily and you may terminate your participation at any time.
11. Neither Real Estate Network Inc. nor “Real Estate Network” shall be construed or deemed as having "procured" you or your services to send or initiate any email or other types of electronic messages to any computer, including for the purposes of promoting “Real Estate Network” or its respective trade or business, or goods, products, property, or services.
12. Neither your participation in “Real Estate Network”'s referral program (including your use of any resource made available and earning or receiving of any commissions or other monies) shall be construed as or deemed to be an inducement for, solicitation of, or payment or provision of other consideration to, you to provide any products or services to “Real Estate Network” Affiliate Network or, except in any written agreement with “Real Estate Network” expressly provides otherwise, to “Real Estate Network”.
13. “Referring User” hereby agrees to indemnify, defend and hold harmless “Real Estate Network” and its affiliates, directors, officers, shareholders, employees, representatives, and agents, from and against any and all liability, claims, losses, damages, injuries or expenses (including reasonable attorneys' fees) brought by a third party, arising out of a breach, or alleged breach, of any of its representations or obligations herein.
14. “Referring User” hereby agrees to indemnify, defend and hold harmless “Real Estate Network” and its affiliates, directors, officers, shareholders, employees, representatives, and agents, from and against any and all liability, claims, losses, damages, injuries or expenses (including reasonable attorneys' fees), as incurred, brought by a third party, arising out of a breach or violation, or allegation which if true would constitute a breach or violation, of any of its representations or obligations in this agreement. To the extent any provision hereof is held to be invalid or unenforceable, such provision shall be enforced to the full extent permitted by law and the remaining provisions hereof shall remain in full force and effect. This letter agreement shall be construed under the laws of the State of California without regard to conflicts of law principles.
15. “Referring User” may with or without notice (a) change, suspend or discontinue any aspect of referring link or any other promotion solutions.
16. Commission will pay continuously over life time of the membership to “Referring User” regarding the referred customers except for these conditions:
1. Terminate “Referring user” membership in “Real Estate Network” for any reason
2. “Referring User” did or will do any illegal work or something against any law in its country of residence.
3. “Real Estate Network” sells or engages in a joint venture and/or changes corporation ownership.
U.S. Export Controls
Any software provided by “Real Estate Network” through the Services (the "Software") is further subject to United States export controls. No Software may be downloaded from the Services or otherwise exported or re-exported (i) into (or to a national or resident of) Cuba, Iraq, Libya, North Korea, Iran, Syria, Sudan, or any other Country to which the U.S. has embargoed goods; or (ii) to anyone on the U.S. Treasury Department's list of Specially Designated Nationals or the U.S. Commerce Department's Table of Deny Orders. By downloading or using the Software, you represent and warrant that you are not located in, under the control of, or a national or resident of any such country or on any such list.
